Wander Nova Private Limited — Legally Binding Terms of Use

1. Introduction and Acceptance of Terms

A. Contractual Relationship

This User Agreement ("Agreement") constitutes a legally binding contract between Wander Nova Private Limited (hereinafter referred to as "Wander Nova," "we," "us," or "our"), a company incorporated under the laws of India, with its corporate office in Noida, Uttar Pradesh, and any individual or corporate entity (hereinafter referred to as "User," "you," or "your") accessing, browsing, or utilizing our website, mobile site, mobile applications, or offline channels (collectively, the "Sales Channels").

B. Explicit Consent

By accessing our Sales Channels or purchasing any services offered by Wander Nova, you explicitly acknowledge that you have read, understood, and agreed to be bound by the terms of this Agreement, our Privacy Policy, and any specific terms applicable to the services you purchase.

C. Modifications

Wander Nova reserves the right to amend, modify, or update this Agreement at any time at its sole discretion without prior notice. Continued use of the Sales Channels following any updates constitutes automatic acceptance of the modified terms.

2. Scope of Services & Role of Wander Nova

A. Aggregator Platform

Wander Nova acts strictly as a facilitator and travel aggregator. We provide a platform that connects Users with third-party global service providers and suppliers, including but not limited to airlines, hotel properties, bus operators, cab rental agencies, railway networks, and consular service teams.

B. Limitation of Liability for Third-Party Suppliers

• Independent Contractors: All airlines, hotels, tour operators, and transit networks available through our platform are independent entities and are not employees, agents, or direct subsidiaries of Wander Nova.
• Service Execution: When you choose to "Travel with us," Wander Nova's contractual obligation is fulfilled upon issuing your booking confirmation, ticket, or voucher. Wander Nova is not liable for the actual acts, errors, omissions, representations, warranties, breaches, or negligence of any third-party travel supplier, including personal injuries, death, property damage, delays, overbookings, strikes, or cancellations.

3. Account Eligibility and Security

A. Age and Capacity

To register an account or execute a booking through our Sales Channels, you must be at least 18 years of age and possess the legal authority to enter into a binding agreement.

B. Credentials Safeguarding

You are entirely responsible for maintaining the strict confidentiality of your account login credentials, passwords, and security-related parameters. Any activity, transaction, or booking executed under your registered account will be deemed authorized by you. You must immediately notify Wander Nova at our Noida corporate team if you suspect any unauthorized breach or misuse of your account.

C. Data Accuracy

You agree to provide true, current, and complete personal and identification data during registration and booking. Wander Nova stores your basic information on secure servers for future references and faster transactions. Providing false information may result in the immediate termination of your account and cancellation of your active bookings without a refund.

4. Booking and Payment Terms

A. Tariff and Pricing

All tariffs, fares, and prices displayed on the Sales Channels are subject to change based on market dynamics, supplier seat inventory, currency fluctuations, and localized taxes without prior notice. A booking is only finalized when full payment is processed, and a unique Wander Nova Booking ID/PNR is issued.

B. Payment Mechanisms

Users may pay via authorized credit cards, debit cards, internet banking, unified payment interfaces (UPI), or digital wallets. All credit/debit card information is handled via highly secure, encrypted third-party payment gateways.

C. Verification and Anti-Fraud Measures

To prevent digital fraud and protect our corporate systems, Wander Nova reserves the right to selectively verify customer information, check credit thresholds, or request identification copies for contactless hotel check-ins or international clearance.

5. Cancellation, Modifications, and Refund Policies

A. Supplier Policies Take Precedence

Every flight ticket, hotel room, tour package, or transport reservation booked through Wander Nova is tightly bound by the specific cancellation, modification, and refund matrices dictated by the end service provider (airline, hotel, etc.).

B. Convenience Fees

Wander Nova reserves the right to charge a non-refundable Convenience Fee or service fee for facilitating bookings through our digital platform. In the event of a cancellation or change initiated by the User, Wander Nova's convenience fees are non-refundable, and an additional standard cancellation service fee may apply.

C. Refund Process

Refunds, if applicable under the supplier's policy, will be processed back to the original source of payment only after Wander Nova receives the respective amounts from the travel supplier. Refund timelines depend entirely on the banks, card networks, and supplier settlement policies.

6. International Travel, Passport, and Visa Services

A. User Documentation Responsibility

For all international travel itineraries booked through our platform, the User is entirely and solely responsible for procuring, maintaining, and presenting all necessary travel documentation, including but not limited to:

• A valid passport with at least six (6) months of validity from the date of travel.
• Approved electronic or physical visas, transit visas, and cross-border entry permits.
• Medical, health certificates, and travel insurance policies as required by destination countries.

B. Visa Services Wing

If you engage Wander Nova's specialized consular team to assist with visa processing, you must provide copies of your passport, bank statements, and original filled application forms. While we provide expert guidance, Wander Nova has zero control over consular decisions. The rejection, approval, or processing delay of any visa application remains the exclusive prerogative of the respective embassy or high commission. Wander Nova is not liable for financial losses arising from visa rejections or delayed passport returns.

C. Financial Compliance (LRS & RBI)

In compliance with the Liberalized Remittance Scheme (LRS) under the Reserve Bank of India (RBI) or other global financial mandates, Users executing international bookings are legally required to provide statutory financial identifiers, such as PAN card details. Wander Nova will handle this data with strict confidentiality, and failure to provide it will result in an immediate inability to fulfill the booking.

7. App Permissions and Proper Use of Sales Channels

A. Minimal Device Access

• SMS Permissions: Exclusively used to auto-read and pre-populate One-Time Passwords (OTPs) to secure your transaction.
• Location Services: Exclusively used to provide location-based geographical services like coordinating real-time cab dispatches and transfers.

B. Prohibited Activities

Users are strictly prohibited from using the Sales Channels to:

• Conduct fraudulent, speculative, or false bookings.
• Deploy automated scrapers, data-mining robots, or deep-linking scripts to extract pricing matrices or intellectual property without explicit written authorization from Wander Nova.
• Post or upload defamatory, abusive, or unlawful content in our reviews or user-generated forums.

8. Indemnification and Limitation of Liability

A. Indemnity Hold Harmless

You agree to indemnify, defend, and hold harmless Wander Nova Private Limited, its directors, employees, affiliates, and suppliers from and against any losses, liabilities, claims, damages, demands, costs, and expenses (including legal fees) arising out of your breach of this Agreement, violation of any law, or infringement of third-party rights.

B. Maximum Liability Cap

In no event shall Wander Nova, its associates, or suppliers be liable for any indirect, punitive, incidental, special, or consequential damages. In any circumstance, the maximum liability of Wander Nova towards a User for any dispute arising out of a booking shall be strictly limited to the total amount received by Wander Nova as service fees/convenience fees for that specific transaction.

9. Governing Law and Jurisdiction

This User Agreement, its performance, and all disputes arising out of or in connection with our services shall be governed exclusively by the laws of the Republic of India.

Any legal action, suit, or judicial proceeding arising directly out of your relationship with Wander Nova Private Limited shall be subject to the exclusive jurisdiction of the competent courts located in Gautam Buddha Nagar (Noida), Uttar Pradesh, India.
